# MosaicEarth Standard License v1.0
This MosaicEarth Standard License ("License") governs the use of a geospatial asset obtained through MosaicEarth under the MosaicEarth Standard License.
The person or entity that publishes and licenses the asset is the **Licensor**.
The person or entity that lawfully acquires the asset through MosaicEarth, whether for free or in exchange for credits or other consideration, is the **Licensee**.
## 1. License Grant
Subject to compliance with this License, the Licensor grants the Licensee a worldwide, perpetual, non-exclusive, royalty-free license to use the acquired asset for personal and commercial purposes.
The Licensee may:
- use the asset in commercial and non-commercial projects;
- reproduce the asset as necessary for permitted uses;
- modify, edit, crop, transform, simplify, optimize or adapt the asset;
- convert the asset into other formats;
- combine the asset with other data, assets or content;
- create derivative works based on the asset;
- use the asset for visualization, mapping, GIS, analysis, research and simulation;
- incorporate the asset into websites, applications, games, virtual environments, audiovisual works, renders and other digital or physical products;
- use the asset in professional work and projects performed for clients;
- sell or distribute products or services incorporating the asset, provided that the asset itself is not distributed or made available as a standalone or reasonably extractable asset.
No additional royalties are payable to the Licensor for uses permitted under this License after the asset has been lawfully acquired.
## 2. Redistribution and Resale Restrictions
The Licensee may not:
- resell the original asset as a standalone asset;
- redistribute the original asset;
- make the original asset available for download by third parties;
- sublicense the asset as an independent asset;
- publish or upload the asset to another asset marketplace, stock library, repository or similar distribution service;
- redistribute a converted, repackaged, optimized or modified version when that version remains substantially equivalent to the acquired asset;
- make modifications whose primary purpose is to circumvent these redistribution restrictions;
- claim authorship or ownership of the original asset.
A derivative work, product or service may be sold or distributed when the asset has been incorporated into a broader work and cannot reasonably be extracted and reused as an independent substitute for the original asset.
## 3. Ownership
All ownership and applicable intellectual property rights in the original asset remain with the Licensor.
Acquiring an asset through MosaicEarth does not transfer ownership of the original asset to the Licensee.
The Licensee retains any independent intellectual property rights they may hold in their own original contributions to derivative works, without acquiring ownership of the underlying original asset.
## 4. Attribution
Attribution to the Licensor is appreciated but is not required under the MosaicEarth Standard License.
MosaicEarth may display the identity of the creator, provenance and other attribution information within the Platform.
Nothing in this section removes attribution obligations or other requirements imposed by applicable law or by third-party rights that the Licensor was legally entitled to incorporate into the asset.
## 5. Licensor Rights and Third-Party Content
The Licensor represents that they own or control the rights necessary to publish the asset and license it under the MosaicEarth Standard License.
The Licensor must not offer an asset under this License when third-party rights or licensing terms prevent the permissions granted by this License.
The MosaicEarth Standard License does not override copyrights, database rights, trademarks, privacy rights, property rights or other rights held by third parties.
Where legally applicable third-party requirements remain attached to source material incorporated into an asset, those requirements continue to apply.
## 6. Permitted Professional and Commercial Use
Subject to the redistribution restrictions in Section 2, the Licensee may use the asset without limitation on the type or number of projects.
Permitted uses include, without limitation:
- GIS and geospatial analysis;
- cartography;
- surveying-related workflows;
- architecture and engineering visualization;
- research and education;
- games and interactive experiences;
- virtual and augmented reality;
- simulations;
- digital twins;
- film and audiovisual production;
- websites and applications;
- presentations and publications;
- commercial services;
- products produced for clients.
The Licensee is responsible for determining whether an asset has sufficient accuracy, quality or legal suitability for a particular professional use.
## 7. No Warranty
Unless expressly stated otherwise, assets are provided **"as is"** and **"as available."**
Neither the Licensor nor MosaicEarth guarantees that an asset is:
- complete;
- error-free;
- continuously available;
- accurate to a particular tolerance;
- suitable for a particular purpose;
- suitable for safety-critical use;
- suitable for legal, cadastral, engineering or surveying purposes;
- compatible with any particular software or system.
Metadata describing accuracy, ground resolution, coverage, acquisition date or other technical characteristics is informational unless expressly provided as a contractual guarantee.
## 8. Liability
To the maximum extent permitted by applicable law, neither the Licensor nor MosaicEarth shall be liable for indirect, incidental, special, consequential or similar damages resulting from the use of or inability to use an asset.
The Licensee is responsible for evaluating the asset and determining whether it is appropriate for the intended use.
Nothing in this License excludes or limits liability that cannot lawfully be excluded or limited.
## 9. Duration and Termination
This License is perpetual unless terminated because of a material breach by the Licensee.
Where a breach is capable of remedy, the Licensee should be provided with reasonable notice and an opportunity to remedy the breach before termination where required or appropriate.
If this License is validly terminated because of an uncured material breach, the Licensee must cease further unauthorized use and redistribution of the asset.
Lawfully created and distributed final products produced before termination are not automatically required to be withdrawn unless required by applicable law or a competent authority.
## 10. License Version
The version of the MosaicEarth Standard License applicable at the time the asset is acquired governs that acquisition.
Future modifications to the MosaicEarth Standard License do not retroactively modify rights already granted under an earlier version.
MosaicEarth may retain records identifying the asset, acquisition, applicable license and license version for the purpose of documenting the rights granted.
## 11. Relationship with MosaicEarth
MosaicEarth operates the Platform through which assets may be published, discovered, acquired, visualized and delivered.
Unless MosaicEarth is identified as the Licensor of a particular asset, MosaicEarth is not the owner or Licensor of that asset.
The Licensor is responsible for having the rights necessary to offer the asset under this License.
Use of the MosaicEarth Platform is also subject to the applicable MosaicEarth Terms of Service.
## 12. Governing Law and Disputes
This License is governed by the law specified in the MosaicEarth Terms of Service applicable to the acquisition.
Any dispute arising from or relating to this License shall be handled according to the applicable dispute-resolution and jurisdiction provisions of those Terms of Service.
## 13. Entire License
This License defines the standard rights granted to a Licensee for an asset acquired under the MosaicEarth Standard License.
No additional restriction displayed elsewhere by a Licensor shall modify this License unless MosaicEarth expressly supports and records such modification as part of the acquisition.
If any provision of this License is found to be unenforceable, the remaining provisions shall remain in effect to the maximum extent permitted by applicable law.
